Take-Two recently sued 3D Realms for its failure to publish Duke Nukem Forever. Now that Shacknews has unearthed the first documents from the case, more details about what the suit entails have come to light. Take-Two alleges that it is owed millions of dollars for 3D Realms' failure to finish the game, and seeks to legally obtain a copy of the source and object code to hold onto while the lawsuit works itself out to ensure that it isn't tampered with.

3D Realms co-founder Scott Miller commented on Shacknews last night about the 12 million dollars that Infogrames was paid for the DNF publishing rights. Miller said that 3D Realms "didn't get a penny of that money," and that 3D Realms will have more to say about the case soon.



Anthony says: I really want to learn more about the case, because I can't understand where all of 3D Realms' budget has been going since it started development on the game over a decade ago. Even Prey, the most recent game the company worked on, had to be outsourced to be finished. Unless Duke Nukem Forever was the longest game ever, or was being coded by a single person, I just don't see how the game's development has taken so long. Hopefully documents that detail the game's development process and timeline will emerge soon, as now I'm just interested thanks to morbid curiosity.
